1. GENERAL TERMS AND CONDITIONS
On one hand, the provider of the products, COSELVA - AGRÍCOLA I SECCIÓ DE CRÈDIT DE LA SELVA DEL CAMP, SCCL, (hereinafter referred to as Coselva), with its registered office at C/ Major, 50, 43470, La Selva del Camp, Tax Identification Number F43012442, customer service phone number 977 844 125, and email address: coselva@coselva.com, owner of the website www.coselva.com, sets forth the contractual document that governs the purchase of products through the aforementioned website.
And on the other hand, the User - Client (hereinafter referred to as the User), registered on the website with a username and password, for which they are fully responsible for use and custody, and responsible for the accuracy of the personal data provided to Coselva.
BOTH AGREE to this document, which entails that the user:
a. Has read, understands and is aware of what is set out in this document.
b. Is of legal age and has legal capacity.
c. Accepts all obligations set forth herein.
d. Has read and accepts these general conditions of purchase from the moment of purchase of any product offered.
These conditions are valid for an indefinite period and apply to all contracts concluded via the Coselva website www.coselva.com.
Coselva reserves the right to unilaterally modify these terms and conditions, without affecting goods or promotions purchased prior to the modification, in order to improve the products offered. In any case, these general conditions should be consulted before purchasing products.
2. PURPOSE OF THE CONTRACT:
2.1 Scope of application: The purpose of this contract is to regulate the contractual relationship of sale and purchase between Coselva and the user at the moment when the user accepts these conditions of sale during the online contracting process by ticking the appropriate box. These terms and conditions are applicable from the day the order is placed.
The sales contract consists of the delivery of a specific product at a price established and published on the website.
2.2 Territory of application: The virtual shop of www.coselva.com is active for the Peninsula and the Balearic Islands.
2.3 Capacity to contract: You must be of legal age and contractually competent to place an order.
2.4 Customer acceptance: The validation of an order via the website www.coselva.com is done by email and implies the automatic acceptance of the general terms and conditions. These terms and conditions are available on the www.coselva.com website or can be sent to you by e-mail on request.
2.5. Modification of the General Conditions of Contract: COSELVA reserves the right to make changes and/or modifications to these terms and conditions. Customers are advised to consult them regularly. If these changes or modifications are introduced after an order has been placed, the conditions in force on the date of the order will apply.
3. INFORMATION PROVIDED ON THE WEBSITE www.coselva.com:
3.1 Publication of prices: The prices of the products are those shown directly in the "Online Shop" section of our website www.coselva.com.
3.2 Product information: The information contained in our advertisements, brochures, other written material and on our website constitutes an invitation to purchase. The content of www.coselva.com is constantly renewed and updated in order to provide our customers with the most complete and detailed information possible. All contractual information on www.coselva.com is presented in the three languages available: Catalan, Spanish and English.
3.3 Availability of the product(s): There may be occasions when it is not possible to supply all products because they are out of stock or not available at the time of purchase. In these cases, the product in question will be visible but not available for purchase.
3.4 Right of Cancellation: COSELVA reserves this action (right of cancellation) of shipping a specific product that does not meet the quality requirements imposed on all products of www.coselva.com. In the event that this lack of quality is detected, the COSELVA Customer Service will suggest a replacement product and, if the replacement is not to your liking, the cost of the product will be refunded.
3.5 Orders 24 hours a day, every day of the year: The order reception schedule is twenty-four (24) hours a day, three hundred and sixty-five (365) days a year.
3.6 Fraud: If COSELVA suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.
4. PURCHASE PROCEDURE:
In order to purchase the products offered by Coselva, the user must register on the website by creating a user account. In order to do so, the User must freely and voluntarily provide the personal data required.
The user chooses a username and password and undertakes to use them carefully, not to disclose them to third parties and to notify Coselva of any loss, theft or access by an unauthorised third party so that it can block them immediately.
Once the user account has been created, the user is informed that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting process will proceed as follows
1.Select the product by clicking on it and press "Add to basket".
2.If you want to add more products, select the "Continue Shopping" option. If you have accidentally added an item that you do not want, click on the option to remove it from the basket.
3.Once you have selected the product(s) you want, click the "Buy" button to complete your order.
4.You will then be asked to enter your login details in one of two ways:
a. User Registration: If you have not previously registered as a user, in order to make a purchase (such registration is free) you must complete a data collection form (in which you must accept the Privacy Policy). Once completed, you will receive a registration confirmation email to the email address provided.
b. If you have already registered and are a customer, you can access your data by filling in the requested username and password fields.
If you do not receive the email, check your SPAM and unwanted email folders and if you still do not receive the confirmation email, contact Coselva Customer Service on 977 844 125 or by email at coselva@coselva.com
1. Once you have registered and authenticated on the site, a screen will appear asking you to enter the delivery address, to proceed you must click on the "Continue" button.
2. You will then be asked to enter a billing address and payment method and click on the "Continue" button.
3. On this screen you will see a summary of the items you have added to your basket and you will be able to add comments to your order.
4. Finally, you will need to accept the "Terms and Conditions of Purchase" and press the "Complete Purchase" button.
In any case, the Coselva contracting platform will inform the user by e-mail, once the contracting procedure has been completed, of all the characteristics, price, transport method, contracting date and delivery times of the purchased product.
If there is any kind of error in the indicated address or in any other point of the order, it must be immediately communicated to the e-mail address coselva@coselva.com or to the telephone number 977 844 125 in order to proceed with the correction of this error.
5. SHIPPING:
5.1 Shipping company: They are made through the company Tipsa, whose customer service centre is at www.tip-sa.com.
5.2 Shipping Costs: Shipping costs will be applied as follows:
Catalonia and the rest of the Peninsula:
Up to 5 kg (5.75€ VAT INCLUDED)
Up to 9.5 kg (7.00€ VAT INCLUDED)
From 10 kg onwards (free shipping)
Balearic Islands:
Up to 10 kg (17.50€ VAT INCLUDED)
Over 10 kg (25.00€ VAT INCLUDED)
When the user-customer adds a product to the cart and confirms the shipping address, the system will automatically display the corresponding shipping cost as indicated above.
5.3 Shipping address: Orders will be delivered to the delivery address freely provided by the user. Thus, Coselva shall not be held responsible if the delivery of the product cannot be carried out due to false, inaccurate or incomplete information provided by the user, or if the delivery cannot be carried out for reasons beyond the control of the delivery company, such as the absence of the recipient.
The delivery of the order will take place during working hours.
Deliveries will only be made to destinations in mainland Spain and the Balearic Islands.
Coselva will use all the means at its disposal to ensure that your order is delivered within the timeframe indicated on our website at the time the order confirmation is issued.
5.4 Delivery Times: Delivery time is usually between 3-5 working days depending on the product, destination and payment method chosen. This period is subject to confirmation of availability and full payment of the order. If products are not available at the time of purchase, our customer service will be able to provide information on availability.
If you have ordered multiple products in the same order, please note that they may have different availability dates and you may receive them on different dates. Please note that if any of the references are not available at the time of despatch, you will be contacted by telephone.
5.5 Shipping Confirmation: When your order is shipped, our carrier will send a shipping confirmation to the email address you provided when you placed your order. The shipping confirmation will include the relevant tracking number so that you can track the shipment via the carrier's website.
5.6 Damages on Delivery: Products will be shipped in secure packaging. If at the time of delivery it is clearly and visibly apparent, without the need to manipulate the shipping or product packaging, that a product is defective as a result of transport damage, or if a defect in the goods received is apparent in the same way, the customer must immediately contact the Customer Service Department by calling 977 844 125 or by sending an e-mail to coselva@coselva.com to request the return of the product(s) in question and its replacement with another in good condition or the refund of the price paid for it, as indicated.
Similarly, if the product is found to be damaged once the package has been opened, although the packaging is in perfect condition, the consumer and user must notify the seller of the lack of conformity within 15 days of becoming aware of it, by calling our customer service number 977 844 125 or by sending an e-mail to coselva@coselva.com.
6. PRICES AND VALIDITY PERIOD OF OFFERS:
All prices displayed in the www.coselva.com shop include the VAT applicable at the time of purchase. All prices on the website are valid and are expressed in Euro (€). Unless expressly stated otherwise, these costs do not include shipping, handling, packaging, transport insurance or any other additional services and accessories associated with the product or service purchased.
VALUE ADDED TAX: In accordance with Article 68 of Law 37/1992, of December 28, on Value Added Tax, the delivery of products is considered located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except for the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the one legally in force at any given time, depending on the specific article in question.
If the User wishes to receive the invoice for the order, he/she must request it during the purchase process.
The prices applicable to each product are those published on the website and automatically applied by the contracting process in the last stage of the same.
In the case of promotions with a limited duration, the promotional discount will apply as long as the order is registered during the promotional period.
The delivery method is detailed in section 5 of these general conditions.
The data recorded by the various payment methods will constitute proof of the date on which the financial transactions were made and will be used to determine whether or not the order is subject to a promotion.

7. PAYMENT METHODS
We describe the payment system available using credit or debit cards. The user must have a valid credit or debit card, indicating all the digits of the card number in the corresponding form. The transaction is formalised when the order is placed. Only secure card payments are accepted, in which the cardholder's identity is authenticated by means of secure electronic commerce ("Verified by Visa" and "MasterCard SecureCode") in accordance with the procedure established by the cardholder's bank. The order will not be considered or processed until the payment has been authorised by your bank.
The SSL (Secure Sockets Layer) system is used, a payment system in a secure environment, as it allows the encryption of the information transmitted during the transaction, guaranteeing its confidentiality.
There is also the "bank transfer" payment method, where once the order has been finalised, all the information necessary for the buyer to make the bank transfer is sent along with the order confirmation.
8. RIGHT OF WITHDRAWAL:
8.1 Right of Withdrawal: Coselva will accept all returns made within 6 days of receipt of the item and in good condition. No product manipulated by the customer will be refunded, as this will be a reason to lose the warranty. Once received in the warehouse, Coselva will check its condition before refunding the amount.
8.2 Return due to an error in the order by COSELVA: If the product does not correspond to the order due to an error attributable to the company, the user must notify the company by e-mail as soon as possible; COSELVA will bear the cost of collecting the product sent in error and will send the one corresponding to the order made.
8.3 Checking of Returns: COSELVA will check and inspect the returned products, once in its facilities, will verify that they have been received in compliance with all the requirements: the product must be returned with all the elements with which it was delivered, without damage or signs of wear of any kind, and not indicating improper use of the goods or different from its own nature, to the address we have provided you with. The customer is responsible for the packaging and protection of the products sent.
9. APPLICABLE WARRANTIES AND AFTER-SALES SERVICES:
9.1 Warranty: All products offered through the website are completely original, unless otherwise indicated in their description.
10. NULLITY OR INEFFECTIVENESS OF THE CLAUSES:
If any of the clauses contained in these General Terms and Conditions is declared null and void or ineffective in whole or in part, such nullity or ineffectiveness shall only affect the clause or part of the clause that is null and void or ineffective, and the General Terms and Conditions shall remain in force in all other respects, considering such clause or part of the clause that has been affected as not having been placed.
11. ONLINE DISPUTE RESOLUTION:
In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for online dispute resolution between the USER and COSELVA, without the need to resort to the courts, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between both. This body is neutral and will dialogue with both parties to reach an agreement, and may finally suggest and/or impose a solution to the conflict. 12. APPLICABLE LAW AND JURISDICTION:
These Conditions shall be governed by and interpreted in accordance with Spanish law, except where expressly provided otherwise. Coselva and the user agree to submit to the jurisdiction of the courts and tribunals of the domicile of Coselva (if it is not considered a consumer within the meaning of the TRLGDCU) or of the user (if it is considered a consumer within the meaning of the TRLGDCU) any disputes that may arise from the provision of the products or services covered by these conditions.

• Law 7/1998, of April 13, on General Contracting Conditions, and subsequent amendments.
